What is a Policy Limits Trace (Also known as a Liability Limits Trace)?

A Policy Limits Trace (Also known as a Liability Limits Trace) is a type of investigation or search used to determine the liability coverage limits of another party’s insurance policy.

In simpler terms, it’s a process used to find out how much insurance coverage (for example, bodily injury or property damage liability) a person, company, or vehicle has under their auto or commercial policy.

Why are Policy Existence Traces important?

Policy Limits Traces (Also known as Liability Limits Traces) are particularly important to attorneys because they provide key information that directly affects case strategy, settlement value, and client outcomes. Here’s why they matter to legal professionals:

a. Assessing Case Value and Strategy

Knowing the defendant’s insurance limits helps attorneys evaluate the realistic recovery potential. It influences whether to settle, pursue litigation, or seek additional defendants with higher coverage.

b. Negotiating Settlements Effectively
Understanding the available policy limits ensures that settlement demands are reasonable and aligned with what the insurer can actually pay. It prevents wasted time pursuing amounts that exceed available coverage.

c. Maximizing Client Recovery
Attorneys can prioritize negotiating for full policy limits when the coverage is limited.

If the limits are low, they can explore other avenues for compensation, such as umbrella policies, other liable parties, or uninsured/underinsured coverage.

d. Avoiding Bad Faith and Ensuring Fair Handling
In personal injury and liability cases, knowing the limits can help attorneys identify when an insurer fails to settle within reasonable limits, a potential basis for a bad faith claim.

e. Efficient Case Management
Early access to liability limit information allows attorneys to allocate resources appropriately, deciding which cases warrant aggressive pursuit versus early settlement.

In short:
For attorneys, a Policy Limits Trace is a strategic tool. It clarifies how much money is realistically available, guides settlement strategy, and supports client advocacy by ensuring the best possible financial outcome within the bounds of available insurance coverage.

What is a Policy Existence Trace?

A Policy Existence Trace (Also known as an Insurance Discovery Trace) is a specialized search used to determine whether an individual, business, or vehicle has an active insurance policy in place, even when specific policy details are not initially known.

It determines whether insurance coverage exists, a crucial first step before pursuing a claim. It ensures that attorneys can identify who insures the liable party and whether there’s an active policy to pursue.

If we are successful, we will provide you with the name of the Insurance Company/Agency, the Policy Number/Claim Number and the Policy Limits.

Why are Policy Existence Traces important?

Policy Existence Traces (Also known as Insurance Discovery Traces) are especially important to attorneys because they provide crucial information early in a case; Helping determine whether a claim is worth pursuing, how to proceed, and against whom. Here’s why they matter to legal professionals:

a. Identifying Potential Sources of Recovery
Attorneys use these traces to find out whether the at-fault party has any insurance coverage that could compensate their client.

If coverage exists, it establishes a realistic path to financial recovery; if not, it helps avoid investing time in cases with no collectible assets.

b. Confirming the Correct Insurer and Policy Details
Policy Existence Traces identify which insurance company provides coverage, ensuring the attorney directs claims, notices, or demands to the right carrier.

c. Strengthening Case Evaluation and Strategy
Knowing whether coverage exists shapes the attorney’s case strategy; From negotiation and mediation to deciding whether litigation is worthwhile.

d. Supporting Due Diligence and Client Transparency
Attorneys have an obligation to investigate all possible avenues of compensation.

Conducting a Policy Existence Trace demonstrates diligence and helps manage client expectations about recovery prospects.

e. Enabling Faster Case Progression
Early confirmation of coverage allows attorneys to move more quickly into negotiation or settlement discussions, reducing delays and improving client satisfaction.

In short:
For attorneys, a Policy Existence Trace is an essential investigative tool. It verifies whether insurance coverage exists and who provides it, allowing them to build an effective case strategy and maximize recovery opportunities for their clients.
